The price represents a specific lot or batch. Different lot or batches may have a higher or lower price per volume depending on the specific technical characteristic of the product. All product data displayed on this Web Site represent our Store Front of immunodiagnostic products where we welcome you to window shop. The performance characteristics of each product represent a specific lot and/ or batch. At the time of your order, other additional product(s) may be available with similar or different specifications. Unless otherwise specified by the customer, Fitzgerald Industries International reserves the right to ship product with catalog specifications. Since the product specifications could change or become unavailable, please contact your technical sales representative for current inventory status and specific product data.

Returns

No returns can be accepted without prior written approval by Fitzgerald Industries International. Only unopened merchandise can be returned. Fitzgerald Industries International must be notified within 10 days of your receipt of the product. All shipping costs and a 25% handling fee will be paid by the customer. In certain cases, a reassay fee may be required. No return of custom manufactured products will be authorized if the product meets the specifications agreed upon prior to shipment.

Alternate Right

We reserve the right to change product specification (i.e. Buffer system) as we see fit to maximize product quality.

Warranty & Limitation of Remedy

Fitzgerald Industries International makes no warranty of any kind, expressed or implied, including warranty of merchantability or fitness for any particular purpose. Data provided on this Web Site and any data provided with the product is only a guideline on how the product may perform in your system. Since every immunoassay system is dependent on many other reagents, over which Fitzgerald Industries International has no control, it is impossible to predict with any accuracy how our product will react in your system. We encourage you to sample one or more of the available lots to determine if the product that we offer is suitable for your unique system. Buyers' exclusive remedy and Fitzgerald Industries International's sole liability hereunder shall be limited to, at Fitzgerald Industries International's option, refund of the purchase price of, or replacement of, all material(s) that does not meet our specification. By acceptance of the product, Buyer indemnifies and holds Fitzgerald Industries International harmless against, and assumes all liability for the consequence of its use or misuse by the Buyer, its employees or others, including, but not limited to, the costs of handling. Said refund or replacement is conditioned on the Buyer notifying Fitzgerald Industries International within ten (10) days of receipt of the product. Failure of Buyer to give notice of said ten (10) days shall constitute a waiver by the buyer of all claims hereunder with respect to said material(s).

Storage

Directions given on an individual data sheet or vial label are an integral part of these terms and conditions and must be strictly followed.

Condition of Sale

All products remain the property of Fitzgerald Industries International until full payment is received by Fitzgerald Industries International.

Reservation of Title

All products are for research use or further manufacture only and should not be used for human, therapeutic or diagnostic applications. Under the U.S. Food and Drug Administration (FDA), the products listed on this Web Site are available only for research uses. The Code of Federal Regulations, Title 21, Sections 312.9 and 809.10 explicitly state that such research products are for investigational use in laboratory research animals or in vitro research. These products are intended for research or further manufacturing use only.

The foregoing is in lieu of all other warranties, expressed or implied, including implied warranties of merchantability and fitness for a particular purpose. In no event shall Fitzgerald Industries International be responsible for loss of profits or indirect or consequential damages, including but not limited to personal injuries resulting from use of the products.
